Ernie Chambers, a Nebraska state legislator, is suing God.
Chambers, an atheist, is seeking an injunction to prevent God from committing acts of violence, such as floods and tornadoes.
“If God is omnipresent,” Chambers said, “then he is here in Douglas County and in this courtroom.”
While the lawsuit sounds frivolous at best, Chambers is trying to make a point.
The Nebraska legislature has tried to twice to pass laws prohibiting frivolous lawsuits. Chambers point is that the courts should be open to everyone without precondition.
“If I had just stood here and said, ‘The courts should be open to everybody,’ then you would all have yawned. This lawsuit grabbed attention,” Chambers said.
Chambers has a point, but so do the critics of frivolous lawsuits. Lawyers love the idea that anyone should able to bring a case to court. Of course, the targets of the frivolous lawsuits are not as pleased with the legal expenses they must bear. The over clogged courts are not so happy either. May be the loser of a court case should pay all the expenses of both sides. That might limit some of the unnecessary cases and free up an overburdened judiciary. There might be a few more unemployed lawyers around though.
Back to Chamber’s lawsuit, God did not appear. Chambers figures that puts the judge in a difficult position. “There’s never been a case like this in the world. We need judicial notice to be taken of God before the (lawsuit) can proceed.”
